It becomes forbidden to have sex with a person who has not expressly said "yes" or actively showed willingness to participate. It is no longer required that the offender has used violence or threat, or abused the victim's especially vulnerable situation, to be convicted.
The government proposes that two new crimes are introduced, negligent rape and negligent sexual attack with a prison term of up to 4 years. Negligence is the view on the circumstance that the other person did not participate voluntarily.
The minimal penalty for the aggravated rape and aggravated rape of a child is increased from 4 to 5 years in prison. The government however proposed not to introduce a classification of "especially hard crime", in spite that it was presented in the [preparatory] investigation.
The criminal protection of sexual offenses against children is strengthened by the negligence of the offender with regard to the child's age. The offender should have it more difficult to refer to the fact that the victim looked older.
Those who have been subjected to a sexual crime should have got support earlier in the process. When a preliminary investigation of sexual crime is launched, a claim of plaintiff assistant shall be made immediately.
The government allocates resources to inform authorities and courts about it. They should even change the curriculum to bring in the question there.

Changes in the legislation are proposed to come into effect on the 1st of July 2018.
