D. On the Summary of Petition D
(1) The respondent testified that, “it provided newly cleaned uniforms are given to foreigners in detention, and from November 2003, the illegal aliens have been detained that sometimes causes to overflowing of the standard of appropriately protected numbers that they are moved to Hwaseong Foreigner Detention Center within 1-2 days in a way of not to interfere with the human rights of the foreigners. Even though it sometimes keeps more foreigners than appropriate number but it handles as quickly as possible in terms of protecting the human rights of foreigners”, and we have confirmed that the foreigners are taken to the Detention center within a few days after arresting the illegal foreigners.
(2) Also, depending on the situation, the number of detainees in a room differs and this is also caused by the inevitable fact of reflecting it on the budget that this would not be deemed as in violation of human rights.
(3) Based on the above situation, the allegation of the petitioner that they treated him inhumane treatment, but the respondent denied such an allegation, and the petitioner does not have the support of its allegations that we consider that the contents of the petition is applicable as not having the factual basis.
3. К моменту получения этого ответа в Комиссию была подана дополнительная жалоба на условия в Убежище, которое было уплотнено более чем в два раза, а истец находился "под Защитой" более месяца.
4. Это решение было процитировано в апелляции в Верховный Суд (см. Exhibit №15 и 16) как подтверждение той идеи, что истец "жалуется не по делу и тем самым нарушает функционирование Иммиграционного Офиса Кореи".
