Последние решения ВС, хорошие новости:

5. Chiles v. Salazar (Conversion Therapy) - запрещать врачам говорить с пациентом о их болезни, даже если это гендерная дисфория - незаконно.
6. National Republican Senatorial Committee v. Federal Election Commission (Campaign Finance) - запрещать политическим партиям тратить деньги на поддержку кандидатов - нарушает Первую Поправку
7. Little v. Hecox (Transgender Athletes) - штаты имеют право (если хотят) запрещать лицам мужского пола, находящимся в плену иллюзии, что они женщины, участвовать в женских спортивных соревнованиях.
8. United States v. Hemani - лишать человека прав, гарантируемых Второй Поправкой, просто потому, что он курил у себя дома марихуану - незаконно. Редкий 9-0 (на самом деле не такой уж редкий, но редкий в политически значимых делах).


Не такие уж хорошие новости:
9. Trump v. Cook (Independent Agencies) - все федральные агенства равны, но одно из них - Федеральный Резерв - равнее и Президенту не подчинено. Правда, это не окончательное решение - Трампу пока запретили увольнять Кук до окончания судебных разбирательств, окончательного же запрета пока нет. Но, судя по позиции Робертса, будет.

10. Watson v. Republican National Committee (Election Law) - суд решил, что считать голоса после выборов можно столько, сколько власти штата захотят, хоть неделю, хоть месяц, хоть год. Почта в США, как известно, дело непредсказуемое, письмо из Лос Анжелеса в Лос Анжелес может месяц идти, а потому и считать голоса можно неограниченно долго.

11. Trump v. Barbara (Birthright Citizenship) - суд решил, что клоунада с anchor babies должна продолжаться, хотя и оставил небольшую лазейку для Конгресса принять закон, говорящий об обратном. Принимая во внимание состояние Республиканской партии, это холоймес, конечно.


По поводу Феда я не сильно грущу - в том, что Фед продолжит показывать Трампу нос, ничего страшного нет. Политика Феда вызывает множество нареканий, и в общем справедливых, но, по-честному, и Трамп невеликий экономист, и полный его контроль над Федом вряд-ли чему-то поможет. С точки зрения практической, большого вреда тут не вижу, переживёт.

С выборами, конечно, решение открывает больший простор для мошенничества - но с другой стороны, мы видели, как они отлично умеют вбрасывть в 4 утра на следующий день, так что запрет считать голоса месяцами проблемы бы не решил. Несколько затруднил бы терхнологию и сделал бы всю эту клоунаду менее позорной и менее посмешищем всех трёх миров, но может так и лучше. Пока основная причина клоунады - неограниченное почтовое голосование без всякого контроля - не устранена, пытаться навести на это дело лоск бесполезны. Надо как минимум проверку ID, как максимум - личное голосование с ID, кроме исключительных случаев.

И самое плохое, конечно, то, что стратегия anchor babies в США продолжит работать. Сейчас размер проблемы - 100-150 тысяч в год, но, конечно, это масштабируется в пропорции к количеству нелегалов (которые являются, конечно, основным источником). Если проблему нелегалов существенно уменьшить, то уменьшится сообразно и этот вопрос.

P.S. Ещё забыл:
12. Chatrie v. United States - запрос данных геолокации телефона в Гугле является "обыском" и регулируется теми же требованиями (т.е. наличие судебного ордера) как и обычный обыск.
Тут я согласен с большинством и не согласен с Томасом и Алито.

Trump v. Slaughter
SCOTUS: The Chief Executive Is, You Know, Like, the Chief Executive

Это, на самом деле, биг дил. ВС (и Робертс во главе его) нашёл в ящике стола свои яйца и заявил - нет, Конгресс не может просто взять и обьявить часть исполнительной власти не подотчётной никому и несменяемой никем, потому что заткнитесь. Президент - глава исполнительной власти, и может эту исполнительную власть осуществлять в рамках всех исполнительных агентств.

Это была очень весомая ставка со стороны Трампа - не играть по правилам дипстейта и пытаться выковыривать бюрократов из каждого кресла годами по процедурам, разработанным самими бюрократами с чёткой целью не допустить именно этого. А просто заявить - я Президент и имею право осуществлять власть Президента. Такой подход несколько раз не прошёл, но в этом, крайне важном случае - суд согласился восстановить полномочия Президента, до тех пор последовательно размываемые и узурпируемые дипстейтом. Как и в случае с Chevron deference, это серьёзный удар по дипстейту, и это хорошо. 

Во всяком случае, второй срок Трампа уже войдёт в историю хотя бы этими результатами.

Конечно, тут есть и опасность - Президент-Демократ, несомненно, тоже будет пользоваться более широкими полномочиями. Но Президенты-Демократы никогда не испытывали проблем с ограничением своих полномочий дипстейтом - они в одной команде, и в той же команде играют тысячи партийных низовых судей, всегда готовых вынести нужное Партии решение. Цели дипстейта и Демпартии практически одинаковы, поэтому никакого серьёзного конфликта там возникнуть не могло, а значит, и вопрос о полномочиях не важен - какая разница, каковы в точности границы полномочий Президента, если все всё равно в одной команде?

Теперь у Трампа есть 2.5 года, чтобы провести как можно более глубокие и болезненные для дипстейта реформы, пользуясь своими, подтвержденными ВС, полномочиями. Посмотрим, насколько это ему удастся.

1. Заморозить арендную плату. Навсегда. Выселить жильца в Нью-Йорке уже практически невозможно, и теперь будет невозможно и делать на аренде деньги. Это не баг, это фича.

2. Естественным образом, арендодатели начинают экономить на расходах - они всё ещё платят налоги, некоторые и ипотеку, а доходы заморожены. Это именно то, чего Партия добивается. Налоги, естественно, резко поднимут. 

3. После того, как достаточное количество арендаторов сократит расходы на достаточном уровне, Партия обьявляет, что рынок в очередной раз не справился, и конфискует "запущеннoe" жильё, передавая их в управление ручным ГОНГО, управляемым родственниками и знакомыми.

4. Через некоторое время, Партия владеет значительным процентом жилищного фонда Нью-Йорка.

Что из этого имеется? Во-первых, конечно, просто тупо бабло. "Бесприбыльные организации", конечно, прибыли не получают - но деньги направлять на благие цели - например, избирательную кампанию очередного коммуняки - вполне могут, вместо того, чтобы кормить всяких там владельцев.
Во-вторых, контроль - будешь ли ты так активно выступать против партии, если партия контролирует, в буквальном смысле, где ты живешь и на каких условиях? Напомню, что аппарат контроля уже в руках Партии, так что если что, жаловаться ты будешь на Партию - самой же Партии, желаю успехов.
Ну и в третьих - полный невозбранный доступ ко всем данным всех жильцов, конечно - кто живёт, где живёт, по какому адресу, где работает, сколько зарабатывает (при сьёме квартиры часто делается background check, ага), всё такое. Уверен, что этим данным Партия всегда найдёт применение.
Плюс, конечно, для людей, полезных Партии, можно наоборот организовать жильё по доступным ценам. Ну и т.д. 

По-моему, вполне неплохая комбинашка.

The Tragedy of John Cleese

He was a Progressive, Liberal degenerate in 1960s uber-white uber-polite Britain. He could take the piss out of the people he saw as uptight and repressed while enjoying the clean, safe streets and quiet little hamlets full of those same uptight, repressed, polite-to-a-fault, helpful, white Christian Englishmen.

The best part was that those same British conservative Anglos were generally pretty humorous about themselves. So, when you made fun of them, they laughed along with you and shook their heads saying 'Ha! You know, Margie, he's got a point!' It was heaven on earth for him, to be a popular counter-culture icon loved by conservatives and liberals alike for being hilarious, but also enjoy the benefits of a strong, stable and homogeneous culture.

Now, he's an old man, staring at a desolate wasteland where in London, Britons are now in the minority. Everyone is suspicious, the hamlets and villages are economic dead-zones. Every week, there's a new group you're not allowed to make fun of, no one has a sense of humour anymore. Little girls are being sold as sex slaves, women are harassed in the street and the men are suspicious and surly over their lowered living standards. The sinking realisation that the world he made fun of, but loved more than anything, is gone forever and will never come back. The horrifying conclusion that his own counter-cultural irreverence may have helped to kill it. So, he impotently gripes on Twitter and wonders where the laughter went, when did the jokes stop? Where are those wonderful, repressed and uptight conservatives?

Для них так и останется парадоксом, почему те самые тупые, надутые, недалёкие, узколобые консерваторы, над которыми так весело было потешаться - позволяли этим потехам существовать невозбранно (ну, может, с мелкими препонами, которые никому так и не помешали всерьёз), расцвести, произвести плоды, которые приносят радость миллионам уже много десятков лет, принести авторам миллионы долларов и всемирную славу...
И в то же время добрые, милые, интеллектуальные и толерантные левые - выжгли всю поляну под ноль напалмом, так что на пепелище распускаются лишь какие-то жуткие мутанты, да и те растут и цветут строго по линеечке, и шаг в любую сторону карается немедленным уничтожением. Как же так, товарищ Сталин, произошла чудовищная ошибка!

Могут ли они осознать, что никакой ошибки никогда не было? Что Партии не нужны раскачиватели её лодки - Партия знает, какую лодку когда надо качать, и это всегда вражеская лодка и никогда - лодка партии. Поэтому все смехуёчки при партийной власти шагают в ногу точно так же, как и всё остальное. Кто-то из них научится шагать. Клиз, к его чести, видимо в ногу шагать не может - и в этом часть его трагедии.

Судя по наличествующим данным, "соглашение" с Ираном - полнейшее говно. Ничем другим оно, собственно, и быть не могло - Иран никогда не будет считать себя связанным никакими договорами с неверными, для них это просто худна, которая может быть - и будет - отброшена в нужный момент. Однако есть ещё вопрос тактики и вопрос сохранения лица - в каком положении стороны оказываются, пусть и временно, на этот момент. И в этом аспекте трудно придумать соглашение говнее того, что получилось.

Со стороны иранской, режим доказал, что США неспособны их скинуть, и более того - вынуждены сами просить мира, несмотря на все свои военные достижения. Что лишний раз доказывает, что размер - не единственное, что имеет значение, и большие батальоны работают лишь в той мере, в которой полководцы имеют яйца их использовать. И не более того. Возможности США оказались сильно ограничены - ни скинуть иранский режим, ни даже заставить их пойти на серьезные уступки США не удалось. Единственное, что Иран сделал - это пустую декларацию о том, что у них не будет ЯО - декларацию, которую они многократно делали в прошлом и насрут на неё точно так же в будущем, как только это станет удобно. Никаких мер по обеспечению этой декларации не предусмотрено.

Со стороны США, сдали всё, что возможно - никаких преимуществ, кроме вышеупомянутой декларации, по сравнению с предвоенным положением, США не получили - наоборот, Иран получил всё, что хотел, и ещё с (совершенно позорной) доплатой. Собственно, и подписание этой самой декларации, по видимому, нужно исключительно одному Трампу, чтобы удовлетворить его манию заключать сделки любой ценой. Чисто чтобы поставить галочку. Никакой пользы - ни к состоянию до войны, ни к состоянию, когда договор не подписан вообще - для США не просматривается. США могли бы выдерживать более высокие цены на нефть ещё очень долго, никакой серьезной зависимости от судоходства в проливе у США нет, таким образом, никакой причины подписывать всё это говно, кроме как чтобы Трампу было приятно - я не вижу. По каким причинам он это сделал - по личному ебанизму или по каким-то скрытым обьективным факторам, которые нам не видны - я не знаю, это мы узнаем позже (возможно), но в любом случае это было его решение и его ответственность.

В более далекой перспективе, США доказали, что справиться со страной размера Ирана - несмотря на подавляющее превосходство на поле боя - они не могут. Или не хотят, что абсолютно то же самое. Россия свои выводы из этого сделала давно, и увы, эти выводы подтвердились, причём даже без необходимости использовать ЯО, чбсх. Китай свои выводы тоже сделает. Сделают и остальные. Это, надо понимать, не проблема Трампа - это долговременная структурная проблема США (и западной цивилизации вообще, но от неё практически остались только США и некоторые островки в Европе, которые сами по себе ничего защитить не могут). Была небольшая надежда, что Трамп сможет начать решать эту проблему - теперь этой надежды нет, Трамп не может (или не желает, что, повторюсь, то же самое). Тень от вьетнамского факапа лежит на американской политике уже полвека, теперь на ней будет лежать ещё и тень от факапа иранского. "Западная цивилизация" как доминирующая сила в международной политике на этом б-м закончилась, остаётся бесполезный европейский пиздёж, с уходом Трампа США в лучшем случае займётся самоизоляцией (если победит Вэнс), с худшем (Гавнюсом) последует по европейскому пути самоубийства. Свой шанс остановить это Трамп успешно проебал, и я не вижу, чем он мог бы до конца своего срока перебить проёб такого масштаба.

Со стороны Израиля, результат не идеальный, но в целом неполохой. Ядерным и ракетным возможностям Ирана нанесен тяжелый ущерб, плюс экономический ущерб тоже немалый - а экономика Ирана и до того была не ахти. Конечно, со временем можно сделать новые ракеты и отстроить новые реакторы, ну так и Израиль спать не будет. Пока что удалось Ирану крепко намять бока, причём с участием США. Лучше, конечно, было бы решить проблему совсем, но это мечты. А в реальности Иран сильно ослабел, а Израиль на некоторое время отвёл от себя немедленную угрозу. Когда она вернётся - а она обязательно вернётся - то эту проблему надо будет опять решать, и в Израиле об этом знают, и несомненно, уже готовятся. Но в целом результат для Израиля существенно лучше результата для США (при учете целей и интересов) - привет конспирологам, они этот вопрос наверняка не упустят.
