You are rejoicing in a remarkably stupid argument. California law, which you properly take for the paradigm of Constitutional protection of free speech, allows for imposing criminal penalties for making many kinds of publicly disseminated utterances, or awarding remedies for damages flowing from the same. Here are some examples.
  1. Disclosure of secrets is generally against the law. Disclosure of state secrets may amount to espionage or treason. Disclosure of private secrets may amount to a Federal crime or a tort such as invasion of privacy. Limited affirmative defenses against these charges and claims may be available on the grounds of whistleblowing, or by establishing that putatively private facts have been previously disclosed to the public. In either scenario, the burden of proof in asserting an affirmative defense would fall on the defendant.
  2. Telling lies or spreading derogatory rumors may be prosecuted as slander, libel, interference with trade, or what have you. Again, the truth of your statements is an affirmative defense to charges of defamation, but not to charges of invasion of privacy or infringement of rights to publicity. Again, the burden of proof in asserting an affirmative defense would fall on the defendant. Additionally, malicious intent in negligently or knowingly originating a factually false defamatory claim is a key element in the torts of slander and libel, whereas merely repeating defamatory statements previously disseminated by others may be subject to qualified immunity.
  3. It is a criminal offense to threaten anyone with physical harm in a way that puts the threatened party in reasonable fear of death or injury. It is a criminal offense to incite hatred or violence in ways that can be reasonably expected to lead to an immediate breach of peace.
In a nutshell, under our law, anyone can sue anyone else for saying bad things about him. On the other hand, a lawsuit of this kind filed in bad faith is subject to court sanctions against the plaintiff and awards of attorneys’ fees and court costs to the prevailing defendant.
