Манифест о правах интернет-пользователей

Группа журналистов, блоггеров, профессионалов и творцов выражает решительное несогласие со включением в проект закона изменений, ограничивающих свободу выражения, информации и доступа к культуре в Интернете. Мы также заявляем, что:

1. Авторские права не должны быть важнее фундаментальных прав граждан на неприкосновенность частной жизни, безопасность, презумпцию невиновности, эффективную судебную защиту и свободу выражения мнений.

2. Приостановление действия фундаментальных прав граждан должно оставаться в исключительной компетенции судей. Предлагаемый законопроект в нарушение положений статьи 20.5 Конституции Испании передаёт исполнительной власти право ограничивать доступ граждан к определённым сайтам.

3. Предлагаемый законопроект создаст правовую неопределенность среди испанских IT-компаний, повредив одну из немногих развивающихся индустрий, а также будущее нашей экономики, что затруднит создание стартапов, станет барьером для здоровой конкуренции и замедлит выход наших компаний на международные рынки.

4. Предлагаемый законопроект угрожает творчеству и мешает культурному развитию. Интернет и новые технологии демократизировали создание и публикацию всех типов контента, который теперь поступает не от старой индустрии, а из многих источников.

5. Авторы, как и все трудящиеся, имеют право жить благодаря своим творческим идеям, бизнес-моделям и деятельности, связанной с их произведениями. Попытка сохранить устаревшую индустрию законодательными изменениями не является ни справедливой, ни реалистичной. Если бизнес-модель этой индустрии основана на контроле копий, что невозможно в эпоху Интернета, она должна искать новые бизнес-модели.

6. Мы считаем, что связанным с культурой индустриям нужны современные, эффективные, надежные и доступные альтернативы для выживания. Они также должны подстроиться под новые социальные привычки.

7. Интернет должен быть свободным, в него не должны вмешиваться те, кто стремится сохранить устаревшие бизнес-модели и остановить свободный поток человеческих знаний.

8. Мы обращаемся к правительству с требованием гарантировать нейтралитет сети [когда сеть работает открыто, без запретов и вмешательства заинтересованных групп - примечание pazzive], что станет основой для развития жизнеспособной экономики.

9. Мы предлагаем настоящую реформу прав интеллектуальной собственности, чтобы обеспечить общество знаниями, содействовать развитию общественного достояния и ограничить злоупотребления копирайт-ассоциаций.

10. В условиях демократии законы и поправки к ним следует принимать только после своевременного публичного обсуждения и проведения консультаций со всеми заинтересованными сторонами. Законодательные изменения, затрагивающие основные права граждан, могут быть внесены лишь в Конституцию страны.

Europeana’s collection of online European heritage passed the 5 million mark in early December, taking the multilingual digital library, museum and archive over halfway to its target of 10 million searchable items in 2010.

Portraits of notable Polish figures, including astronomer Copernicus and composer Frederic Chopin are among the newest additions to Europeana – part of some 257,000 images, texts, videos and sounds that were submitted by regional groups across Poland. The influx takes the proportion of Polish items on Europeana from 0.4 percent of the total to 5.5 percent.

“Connection with Europeana is a crucial milestone for the long process of the development of the Polish digital libraries infrastructure,” says Marcin Werla, Digital Libraries Team Leader at the Poznan Supercomputing and Networking Center, which has been leading the Polish project to feed digitized items into Europeana.

“As the first country from the EuropeanaLocal project, we were able to connect several hundreds of cultural and scientific institutions from the entire country.”

The achievement is a milestone not just for Europeana but also for EuropeanaLocal, a project that helps regional libraries, museums, archives and audio-visual archives contribute to Europeana.

Content will keep flowing from EuropeanaLocal. New items from the UK and Norway are already being processed. EuropeanaLocal aims to add some 3 million items to the Europeana database by mid-2010, making it one of the biggest contributing projects.

Sony announced Thursday morning that it will sell subscriptions to the digital edition of the Journal as well as a daily summary of news events available only to owners of the Sony device. In addition, users will be able to subscribe to a daily summary of news stories and columns from MarketWatch.com, which like the Journal is owned by Dow Jones & Co.

The Journal summary will cost $5 a month on top of the $14.99 monthly charge for the digital edition of the paper, while a subscription to the MarketWatch product will cost $10.99 a month.

They dress up their thievery in high-minded rhetoric about how they are the true defenders and inheritors of creativity, and they have sold this claim around the world to regulators and lawmakers alike. There are members of Parliament and Congress-people who are unduly influenced by them. They say they’re only trying to preserve the way it’s always been. They claim that their radical agenda is somehow conservative. But what they really see is a future in which the electronic culture market grows by leaps and bounds and they get to be at the centre of it. They claim that this is about ethics, but anyone who thinks about it for a minute can see that it’s about profit.
