Australia is working with the Dutch and other nations to approve a specially convened international judicial body to put Russia and Russian-backed soldiers on trial for the murder of 298 people aboard Malaysia Airlines MH17.
The governments of Australia, The Netherlands, Ukraine, Belgium and Malaysia are looking at all legal avenues to prosecute those responsible for blowing the commercial passenger aircraft out of the sky on July 17, 2014, killing all on board, including 38 Australians.
A decision on how to go about the trial is expected in the next few weeks but it could take place in The Netherlands or Ukraine, both of which have European jurisdiction for the flight. Any prosecution has been made more complicated because Russia has vetoed any involvement of the UN Security Council in forming an independent tribunal.
The trial is also likely to proceed without specific soldiers being present, although high-level sources told The Australian “that doesn’t mean they can’t be tried in absentia’’.
