32 U.S. Code § 109 allows for any state plus DC, PR, Guam and Virgin Islands to maintain a defense force that is separate from the National Guard, solely under the authority of the state government, and cannot be federalized. SDFs are explicitly not within the armed forces. American Samoa and Northern Mariana Islands are not mentioned in § 109, so by default they are disallowed from maintaining SDFs.
