Wrong on both counts. The Terms of Service ensure that the body of LiveJournal postings signed by its members is subject to a restriction on public access that satisfies the conditions laid out in Golden Gateway Center v. Golden Gateway Tenants Association, 26 Cal. 4th 1013 (2001), holding that there is no state action and no California constitutional right of free speech on private property on which access by the public is restricted. (See the discussion in Slauson Partnership v. Ochoa, 112 Cal. App. 4th 1005 (2003).) As for your incitements to imminent lawless action, they fall within the category of unprotected speech defined in Brandenburg v. Ohio, 395 U.S. 444 (1969).
