Sony argued mod-chipping was solely about piracy and said there was no such thing as an authorised back-up copy in Australian law.

Professor Fels begs to differ, pointing out that Section 47c of the Copyright Act allows users to make a single back-up copy of a computer program to use if the original copy is lost, destroyed or rendered unusable.

The ACCC believes this provision applies to all computer programs, including games.

However, Clayton Utz copyright lawyer Peter Knight, who was not involved in the case, said there was precedent in Australian case law to suggest that video and computer games were classed as films as well as computer programs.

The back-up provisions in the Copyright Act do not apply to copying films.

Mr Knight acknowledged this was an untested area of law but said his view was that it was illegal to make back-up copies of video games.
