Microsoft says Eolas' invention didn't work, and that its own Web browser uses different technology. Microsoft also invoked a "prior art" defense, arguing that Eolas' technology is based on a large body of public knowledge

I didn't borrow that pot, the pot was broken when I borrowed it, and it wasn't broken when I returned it!

Here it sounds more like the journalist had no idea what he was talking about and tried to describe it in his words, which, of course, resulted in even more nonsense.

But yeah, law is often like that: "I didn't take that pot. But if you find that I did, then i certainly had a good reason for taking it."
