In support of Despised Speech
По поводу ж позиции Abuse livejournal.com,
выступающей в роли цензора в русскоязычной блогосфере,
некоторые возмущаются, а другие оправдывают ее так:

...кое-кому хочется использовать американский ресурс для

антиамериканской деятельности. Их обламывают.

И действительно, о какой "свободе слова" может идти речь,
если человек занимается антиамериканской деятельностью?
Право на свободу слова имеют только люди, чья лояльность
американским ценностям несомненна.

Это официальная позиция путиноидов и прочей
правозащитной и либеральной мрази, которую
всю аж распирает от желания подвергнуть цензуре
Интернет.

Abuse, вероятно, так тоже думает. Но прямо
заявить нечто подобное - верх неприличия,
так что доморощенные стукачи-защитнички
Abuse, сами не осознавая того, изобличают ее
пуще любого борца за свободу.

В Америке, "свобода слова" понимается
совершенно иначе

"The principle of free thought is not free thought for
those who agree with us but freedom for the thought we
hate." US Supreme Court Justice Oliver Wendell Holmes in
United States v. Schwimmer
(1929).

Хомский сказал по этому поводу чрезвычайно
разумное. "Геббельс и Сталин были защитниками
свободы слова, но понимали ее как свободу говорить
то, что им нравится. Если вы выступаете за
свободу слова, вы должны выступать за свободу
говорить вещи, которые вам отвратительны.
Иначе вы противник свободы слова."

Что ж касается политической цензуры, которую
осуществляет Abuse, то она, действительно,
противоречит законам штата Калифорния,

поскольку по законам Калифорнии в публичном
месте нельзя ограничивать свободу слова
(а призывы убить НАТО, безусловно, защищены
Первой Поправкой).

Вообще к американским "свободам" и "демократии"
может быть много претензий, но в интерпретации
отечественных защитников "демократических
ценностей" (от отъявленных путиноидов до правозащитников
на американские гранты) эти "демократические ценности"
раз от разу оказываются отъявленным фашизмом.

Мораль этого простая - если нам придется
выбирать между отечественными "демократами",
вооруженными демократизатором, и американскими,
вооруженными библией, долларом и микки-маусом,
следует выбирать микки-мауса. Сербы вот выбрали
и не жалуются.

"Суверенная демократия" идет на говно.

You are refusing to understand that contractual arrangements of TOS function for LJ as a counterpart of an apartment lease for a residentlal complex. Your argument might apply to a wiki, which is arguably a modern-day equivalent of a town square characterized by Robins v. Pruneyard. But American town squares allow open access to pedestrian traffic, unimpeded by any form of user authentication subject to contractual terms. In this regard, LJ functions like the Golden Gateway apartment complex, and unlike the Pruneyard shopping center. American courts are vigilant in protecting property rights. Golden Gateway is a good example of that.
    As regards your incitements to kill this or that, good luck finding an American jury that would interpret them as anything other than a call for unlawful indiscriminate extermination.
    The proof of the pudding is in the eating. I got booted from a Yahoo! discussion board for expressing contrary opinions (http://larvatus.livejournal.com/29125.html) related to an ongoing civil lawsuit. I have successfully staged numerous realspace protests on public and private property. After spending around $500,000 on legal fees, I have a fairly good grasp of the limits of free speech in a private forum open to the public under contractual arrangements.
    Men differ from boys by paying for their eccentricities. The way you carry on suggests that you expect somebody else to pick up the tab. If my findings are not to your liking, try paying for your own.

So does LJ: reading/posting comments does not require authentication.

Reading LJ or posting comments in it does not require authentication. But at issue is the LJ owners’ right to delete the accounts of their registered users, upon accusing them of violating TOS. I would pay pretty penny for a legal outcome that affirmed the right of registered users of online communities to free speech in violation of their agreed upon TOS. Unfortunately, that is not going to happen.
    As for the targets of calls for unlawful indiscriminate extermination, I am not too concerned about pinpointing their identity. The stringent test of Brandenburg v. Ohio needs not be satisfied in determining the fact of TOS violation. In fact, TOS XIV.5 stipulates that “LiveJournal and its designees shall have the right (but not the obligation) in their sole discretion to remove or refuse or remove any Content that is available through the Service.” Your sole realistic remedy upon finding yourself a victim of such refusal or removal, would be to negotiate for a backup copy of your user contributed content, on the grounds of your intellectual property rights vested therein. Forcing LJ to maintain on their servers any specific content contributed by any given user is a judicial non-starter for a variety of reasons, beginning with their liability for doing so.
